Please read these terms carefully. By accessing or using https://autoguardtrust.com, you agree to be bound by these terms, including the arbitration agreement and class-action waiver below.

1. Who We Are; What This Service Is

https://autoguardtrust.com is operated by Auto Guard Trust LLC (“we,” “us,” “our”). Auto Guard Trust is a marketing and lead-generation service that helps connect consumers interested in auto insurance with third-party licensed insurance providers, agents, and marketing partners (“Partners”). We are not an insurance company, agent, or broker. We do not sell, solicit, negotiate, quote, bind, or provide advice about insurance. We do not guarantee that any Partner will contact you, offer coverage, or offer any particular rate or terms. Any insurance transaction is solely between you and a licensed Partner.

2. No Insurance or Professional Advice

Content on the Sites is for general informational and marketing purposes only and is not insurance, legal, or financial advice. Insurance products, eligibility, rates, and terms are determined solely by licensed Partners and may vary by state and individual circumstances.

3. Eligibility

You must be at least 18 years old and a U.S. resident to use the Sites and submit information.

4. Consent to Be Contacted

By submitting your information or calling a number on the Sites and providing the consent presented at submission, you authorize us and our Partners (and parties acting on their behalf) to contact you by phone call, text message, and email — including by automatic telephone dialing system, automated technology, and prerecorded or artificial voice — about auto insurance and related products, even if your number is on a Do-Not-Call list. Consent is not a condition of any purchase, and you may revoke it at any time as described in our Privacy Policy. Message frequency varies; message and data rates may apply; reply STOP to opt out, HELP for help.

5. Your Responsibilities

You agree to provide accurate, current, and complete information and to use the Sites only for lawful personal purposes. You agree not to submit information about anyone other than yourself without their authorization, and not to misuse, scrape, reverse engineer, or interfere with the Sites.

6. Intellectual Property

The Sites and their content are owned by us or our licensors and are protected by applicable laws. You may use the Sites only for your personal, non-commercial use; all trademarks are the property of their respective owners.

7. Third-Party Partners and Links

Partners and any linked third-party sites are independent of us. We are not responsible for Partners’ or third parties’ products, services, communications, accuracy, or privacy/data practices, and your dealings with them are solely between you and them.

8. Disclaimers

The Sites and all content and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Sites will be uninterrupted, error-free, or secure, or that any Partner will provide any product, quote, or rate.

9. Limitation of Liability

To the maximum extent permitted by law, in no event will Auto Guard Trust LLC or its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Sites or any contact by or dealings with a Partner, on any theory of liability. Our total liability for any claim shall not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Auto Guard Trust LLC and its affiliates from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Sites, your information, or your breach of these Terms.

11. Agreement to Arbitrate; Class-Action Waiver

Please read this section carefully — it affects your legal rights.

(a) You and Auto Guard Trust LLC agree to resolve any and all disputes between us through binding individual arbitration, except disputes that qualify for small-claims court and intellectual-property disputes. This includes disputes arising out of or relating to these Terms, the Privacy Policy, the Sites, your information, marketing communications, and claims under the Telephone Consumer Protection Act (TCPA) and similar laws. These terms are governed by the Federal Arbitration Act.

(b) Before filing, a party must send a written Notice of Dispute to Auto Guard Trust LLC, 30 N. Gould St Ste R, Sheridan, WY 82801, Attn: Legal, describing the claim and relief sought; if not resolved within 30 days, either party may begin arbitration.

(c) Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, by a single arbitrator, in the county of your residence or by videoconference.

(d) You and Auto Guard Trust LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. If this class-waiver is found unenforceable, the entire arbitration agreement is null and void.

(e) You and Auto Guard Trust LLC waive any right to a jury trial. You may opt out of this arbitration agreement by sending written notice to the address above within 30 days of first accepting these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles, and, where applicable, the Federal Arbitration Act. Subject to the arbitration agreement, exclusive venue lies in the state or federal courts located in Wyoming.

13. Changes; Termination

We may modify these Terms at any time by posting the updated version with a new “Last Modified” date; continued use constitutes acceptance. We may suspend or terminate access at any time.

14. Miscellaneous

These Terms are the entire agreement between you and us regarding the Sites and supersede prior agreements. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may.
